REGISTRATION
Registration papers with the NSDR and/or ASDR are included and will be provided to the buyer upon full payment of the dog/puppy and when the breeder receives written confirmation from a licensed veterinarian that a spay/neuter appointment was conducted for the dog/puppy IF sold on a spay/neuter contract. If sold as breeding/show quality, upon receipt of full payment registration papers will be provided to the buyer of said dog/puppy.
DEPOSIT
An amount of $150 will be accepted as a deposit to reserve said dog/puppy for buyer. Deposits are non-transferrable once buyer has reserved their puppy. ONLY APPLYING TO LITTERS BORN AFTER 1/1/10: When the breeder has been provided written documentation by a licensed veterinarian that a spay/neuter appointment was completed, the buyer will receive their $150 deposit back. Dogs/puppies can be either “Available”, “On Hold”, “Sale Pending”, “Reserved”, “Not Available” or “Sold”.
Available - for sale, with no pending contracts or buyers reserved
On Hold - a courtesy we will extend for a limited time (at our discretion)
Sale Pending - a verbal agreement to buy, pending a deposit and signed contract from buyer
Reserved - there is a signed purchase contract and deposit on the puppy
Not Available - retained for co-ownership or our breeding program
Sold - the puppy is paid in full and gone to his/her new forever home.
Breeder will accept payments for dog/puppy. Length of payment period must be agreed upon by breeder and buyer before sales contract is signed.
HEALTH
Breeder guarantees that the dog/puppy is healthy and free of known contagious diseases and has had vaccination(s) required for its age at the time of this agreement. The buyer agrees to have the dog/puppy examined by a licensed veterinarian within three (3) business days
of receiving the puppy. IF the dog/puppy is determined to be in poor health by a veterinarian, the Buyer can choose whether to keep the dog/puppy, assuming all costs for its care, or may return the dog/puppy for a full refund once the breeder receives a written statement from the veterinarian regarding the dog's/puppy's health. This guarantee will expire three (3) business days after the Buyer takes possession of the dog/puppy.
COAT/EYE COLOR
Breeder will not give any guarantees for color of eyes, color of haircoat and/or height the dog/puppy may be. Breeder can only guess what the size may be depending on the height of the puppy's parents. Eye color will be determined at 8 weeks of age, but can change a different color as the dog/puppy ages, therefore, breeder can make no guarantees regarding eye color.
DEFECTS/DEATH
Breeder guarantees this dog/puppy is free of genetic hip or eye defects for one (1) year. If hip or eye defects do occur within this time frame, Buyer will provide written certification from the Orthopedic Foundation for Animals (OFA) or the Canine Eye Registration Foundation (CERF), as evidence of the defect. The guarantee consists of replacement of the dog/puppy with a dog/puppy of equal or better quality, selected by the breeder, when breeder has next available litter of puppies. Breeder makes no guarantee regarding the loss of the dog/puppy because of accidental death, theft, sickness, any kind of worms etc., or any other loss beyond the Breeder's control, except as stated above.
LIVING CONDITIONS
Buyer certifies, by signing this agreement, that the dog/puppy:
Buyer also certifies, by signing this agreement that he/she will not resell this dog/puppy to a pet store or medical research facility.
PET QUALITY & SPAY/NEUTER CONTRACT
The dog/puppy is being sold as Pet Quality which is defined as a puppy that is not guaranteed to show in conformation classes and will not be used for breeding purposes. If the dog/puppy is sold as a pet with no breeding rights, then the dog/puppy should be spayed/neutered no later than the age of seven months. No registration papers will be issued until the dog/puppy is altered. When Breeder receives written proof from a licensed veterinarian that the dog/puppy has been altered, the papers to register your dog/puppy will be sent via mail.
RELINQUISHING OWNERSHIP
This Sales Contract is non-transferable. This Sales Contract will be deemed void if the Buyer relinquishes ownership of the said dog/puppy. Should the Buyer decide to sell the dog at any time, Buyer agrees to first contact Breeder and allow the Breeder the first opportunity to purchase the dog back.
The above guarantees are valid only so long as Breeder is breeding Toy and Miniature Australian Shepherds. Should the Breeder cease breeding for any reason, this Sales Contract will become null and void.
In the event of a dispute, the state of Washington will have jurisdiction over the matter.
